Australia – Consumer Guarantees & Refunds

Under Australian Consumer Law (ACL), consumers are entitled to refunds for digital goods that:

• Are faulty, not as described, or do not function as advertised.
• Change substantially after purchase due to VYB’s modifications.

VYB does not provide refunds for change-of-mind purchases after seven (7) days, unless required by Australian law.

Customers who dispute transactions by filing chargebacks may have their accounts suspended or terminated.

• A chargeback will result in immediate account suspension pending investigation.
• Multiple chargeback attempts may result in permanent account termination.

If there are suspicious refund patterns linked to multiple accounts, VYB reserves the right to investigate before issuing any refund.

Prohibited Uses

The following actions are strictly prohibited and constitute copyright infringement, piracy, and intellectual property theft:

• Downloading, recording, copying, distributing, or redistributing any VYB video content in any format, including screenshots, screen recordings, or derivative works.
• Embedding, live-streaming, or broadcasting VYB videos on any third-party platform (e.g., YouTube, TikTok, Facebook, Instagram, Twitch, Discord, or any other online forum) without express written consent from VYB.
• Using VYB’s video content in any third-party media, including reactions, reviews, critiques, commentary, news reports, blogs, podcasts, or articles—regardless of claims of "fair use."
• Repurposing VYB’s video content in any way that misrepresents, defames, discredits, or falsely portrays VYB, its services, business operations, team members, or affiliates.
• Altering, distorting, or manipulating VYB video content in any manner, including splicing, editing, adding overlays, deepfakes, voice modifications, or using AI-generated elements to misrepresent VYB.
• Using VYB video content to make false claims, scam allegations, negative portrayals, or misleading accusations that damage VYB’s brand, credibility, or business reputation.
• Utilizing VYB video content to harass, threaten, intimidate, or incite targeted online abuse toward VYB, its representatives, employees, customers, or partners.

Legal Enforcement & Consequences

VYB actively monitors and enforces copyright violations across all platforms and reserves the right to take the following actions against unauthorized use:

• Immediate DMCA takedown requests on infringing platforms (YouTube, TikTok, Twitter/X, Facebook, Instagram, Reddit, etc.).
• Cease-and-desist orders and legal demands for the removal of unauthorized content.
• Monetary claims for damages, defamation, and lost revenue due to reputational harm caused by unauthorized or misleading use of VYB content.
• Legal action for copyright and trademark violations, including potential criminal and civil penalties under U.S. and international intellectual property laws.
• Permanent ban from VYB’s platform, services, and ecosystem.

No Exceptions – No "Fair Use" Allowance

VYB does NOT grant permission for any form of unauthorized video usage, including but not limited to:

• “Fair use” defenses for criticism, news, commentary, parody, or satire. VYB explicitly rejects unauthorized third-party use of its content under any such claims.
• Alleged educational, non-commercial, or “informational” purposes. All content remains copyrighted and may not be republished, excerpted, or used in any educational or journalistic capacity without direct written authorization.
• Content creators, influencers, reaction channels, review pages, or investigative journalists. Unauthorized use of VYB videos for third-party narratives, whether positive or negative, remains strictly prohibited.

Reporting Unauthorized Use

If you encounter unauthorized use of VYB video content, please report it immediately by contacting [email protected].

By viewing, accessing, or interacting with VYB video content, you acknowledge and legally agree to these terms. Violating these terms constitutes a direct breach of copyright and intellectual property laws, and will be subject to immediate legal action.

VYB Partner Agreement  (Independent Business Owner)

THIS AGREEMENT is entered into by and between VYB Collective LLC, a Wyoming limited liability company with principal offices located at 5830 E. 2nd St, STE 7000, #21838, Casper, WY 82609 ("VYB," "Company," "we," or "us"), and the undersigned Independent Business Owner, referred to as "VP (VYB Partner)," "Independent Business Owner (IBO)," "you," or "your."

By enrolling as a VYB Partner, you acknowledge and agree to the following terms:

1. Authorization and Contractual Agreement

You are authorized as a VP to market and promote VYB’s products and services as outlined in this agreement, the VYB Policies and Procedures, Compensation Plan, Income Disclosure Statement, Privacy Policy, and Terms & Conditions (collectively, the "Agreement"). All VPs must adhere to these policies as detailed at thevyb.io/policies.

2. Independent Contractor Status

You agree that you are an independent contractor and not an employee, agent, or legal representative of VYB. You have no authority to bind VYB to any contractual obligations. You assume sole responsibility for all applicable taxes and business expenses related to your activities.

3. Membership Levels & Fees

To participate in the VYB Compensation Plan, you must maintain an active VP Kit and appropriate monthly membership:

• VP Kit: $9.99/month (mandatory to earn commissions).
• Elevate Membership: $39.99/month (PCV: 40).
• Pro Membership: $159.99/month (PCV: 160).
• Legend Membership: $249.99/month (PCV: 250).

4. Term and Renewal

This Agreement shall remain in effect for one year from the effective date and automatically renew annually upon payment of your annual VP renewal fee (equivalent to monthly VP Kit fee, unless otherwise amended). You may terminate this Agreement at any time with written notice to the company.

5. Compensation Plan

As a VYB Partner, your earnings potential is outlined in the VYB Compensation Plan:

• Legacy Network Earnings:
  • Pro: $3/month per active Pro/Legend member.
  • Legend: $5/month per active Pro/Legend member.
  • Potential monthly earnings cap: $442,860.
• Fast Start Bonuses:
  • Pro referrals: $20 per referral (Level 1).
  • Legend referrals: $40 per referral (Level 1).
  • Level 2 bonuses apply per detailed compensation guidelines.
• Check Match Bonuses:
  • Level 1: 100% match.
  • Level 2: 50% match.
• Direct Sales Commissions:
  • VYB Spotlight, BrandWorks: 20% commission.
  • Ventures funding solutions: Custom commission structures.
• VYB Bucks:
  • Expiration and redemption conditions apply per VYB Policies.

6. Marketing & Use of Intellectual Property

• You must follow all guidelines outlined in the VYB Brand Kit regarding use of logos, trademarks, and brand materials.
• Unauthorized alterations, misuse, or distribution of VYB’s intellectual property and marketing materials are strictly prohibited.

7. Refund Policy & Product Returns

VYB refund policies comply with global regulations:

• Standard: 7-day refund if digital content is untouched.
• EU/UK: 14-day cooling-off period applies, subject to conditions outlined in the VYB Refund Policy.

8. Confidentiality and Non-Solicitation

• You must keep confidential all non-public information acquired through VYB activities.
• You agree not to solicit, recruit, or encourage any VYB customers or VPs to participate in any competitive business venture during the term of your agreement and for 12 months following termination.

9. Prohibited Activities

Activities strictly prohibited include, but are not limited to:

• Use of automated bots, fraudulent activities, and deceptive marketing practices.
• Unauthorized sharing of account credentials.
• Harassment, threats, hate speech, and other inappropriate conduct.
• Violation of applicable laws and regulations.

Violation of these provisions may result in immediate termination of your VP status and possible legal action.

10. Income Disclosure

You acknowledge that:

• No earnings or success are guaranteed.
• Earnings depend on individual effort, skill, dedication, market conditions, and other factors outlined in the VYB Income Disclosure Statement.

11. Dispute Resolution & Governing Law

• All disputes arising under this Agreement will be resolved through binding arbitration in Casper, Wyoming, USA.
• This Agreement shall be governed by the laws of Wyoming, USA.

12. Limitation of Liability

VYB will not be liable for indirect, special, incidental, consequential, or punitive damages arising out of or related to this Agreement.

13. Data Privacy Compliance

VYB complies with global data protection laws (GDPR, CCPA, LGPD). Your personal data is handled per the VYB Privacy Policy.

14. Amendments

VYB reserves the right to modify any part of this Agreement at any time, with notice provided via the official website or direct communication channels. Continued use of VYB services signifies your acceptance of amendments.

15. Miscellaneous Provisions

• Severability: If any provision is deemed invalid, the remainder of the agreement remains in effect.
• Assignment: You may not assign your rights without written consent from VYB.
• Entire Agreement: This document, along with the referenced VYB Policies, constitutes the complete Agreement between you and VYB.
